Terms of Service

These Terms of Service (“Terms”) govern your use of BareMetalBox services. By using our services, you agree to be bound by these Terms. Please read them carefully before using our bare metal server hosting services.

BareMetalBox provides dedicated bare metal server hosting services including:

• Dedicated physical server hosting
• Network connectivity and bandwidth
• BGP routing services
• Data center facilities access
• Optional DDoS protection services
• Technical support services

To use our services, you must:

• Provide accurate and complete registration information
• Be at least 18 years old or have legal capacity to enter contracts
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized use of your account
• Accept responsibility for all activities under your account

You agree not to use our services for:

• Illegal activities or content that violates applicable laws
• Spam, phishing, or other malicious communications
• Hosting or distributing malware, viruses, or harmful code
• Unauthorized access to third-party systems or data
• Activities that could damage our infrastructure or other customers
• Copyright infringement or intellectual property violations
• Adult content involving minors
• Activities that violate export control laws

Payment terms for our services:

• Services are billed monthly in advance
• Payment is due within 7 days of invoice date
• Late payments may result in service suspension
• All fees are non-refundable unless otherwise specified
• Price changes require 30 days advance notice
• You are responsible for all taxes and fees

We strive to provide reliable service with:

• 99.9% network uptime target (excluding scheduled maintenance)
• Scheduled maintenance windows with advance notice
• Best effort support response times during business hours
• Service credits for qualifying outages exceeding SLA thresholds

SLA credits are your sole remedy for service outages.

Regarding your data:

• You retain ownership of all data you store on our servers
• We may access your data only as necessary to provide services
• You are responsible for maintaining backups of your data
• We will cooperate with lawful requests from authorities
• Data may be deleted after account termination

Our liability is limited as follows:

• Total liability shall not exceed fees paid in the past 12 months
• We are not liable for indirect, incidental, or consequential damages
• You acknowledge that you use our services at your own risk
• Force majeure events excuse performance obligations

Either party may terminate services:

• With 30 days written notice for any reason
• Immediately for breach of these Terms
• Immediately for non-payment of fees
• Upon termination, you must remove all data from our servers
• Surviving provisions include payment obligations and liability limitations

• These Terms constitute the entire agreement between parties
• We may modify these Terms with 30 days notice
• These Terms are governed by Virginia state law
• Disputes shall be resolved in Virginia state courts
• If any provision is unenforceable, the remainder remains valid
